Second Instance Trial of Case of “Bandit Mao” and “Steamed Bun” Opens on March 30 in Zhaoyuan, Shandong

On March 30, the second instance trial of Wang Jiangfeng, arrested on suspicion of “picking quarrels and provoking troubles” for referring to Mao Zedong as “Bandit Mao” and Xi Jinping as “Steamed Bun” in online posts, opened at the Zhaoyuan City Detention Center, Yantai, Shandong Province.  Wang’s two defense lawyers pleaded not guilty on his behalf, and stated that the case “raises serious issues with regard to freedom of speech.” Only Wang Jiangfeng’s younger sister and her husband were allowed to observe the trial, while more than ten other family members and friends were blocked at an intersection over 300 meters away from the trial location. The trial ended with no judgment, which, presumably, will be announced at a later date.


山东招远“毛贼”、“包子”案3月30日第二次开庭

2017年3月30日,山东烟台招远王江峰,因在微信、QQ上称毛泽东为“毛贼”、称习近平为“包子”,被指控“寻衅滋事罪”一案,在招远看守所法庭第二次开庭审理。第一次开庭是在3月23日。

30日的第二次开庭,仍由山东泰诚律师事务所李永恒律师、山东信常律师事务所祝圣武律师出庭做无罪辩护。

检方公诉人于岩等出庭支持公诉。

早上8点30分左右,律师及王江峰亲友到达距离看守所300余米的一条小路的路口,但发现,路口已经设置了路障,十余名身着便衣的男子阻止律师及亲友进入。律师让其出示证件,他们称“没有理由出示证件”;律师询问谁是他们的负责人,回应称:“没有负责人,就是不让你们进。”律师申明出席庭审,他们也不予理睬。直至僵持了20多分钟,离开庭不足10分钟,律师才得以被允许步行前往300多米外的法庭。

本次开庭,法院方只允许王江峰的妹妹王江云及其丈夫两人进入法庭旁听,其他10多位亲友均被阻截在300多米外的路口。

30日的第二次庭审,控方仍然认为王江峰在微信、QQ上称毛泽东为“毛贼”、称习近平为“包子”,是贬损已故和现任国家领导人的行为,破坏社会秩序,情节恶劣,建议法庭判处王江峰有期徒刑3年。

检方公诉人在庭审中,出示的证据如第一次庭审,是微信和QQ截图复印件,并当庭播放了光盘,如“一人一票颠覆政府”、“阅兵时左手举在额前”、“宽衣解带”等。

两位律师做了无罪辩护。

律师在答辩词中称:“对王江峰寻衅滋事罪案的起诉,存在严重的迫害言论自由的嫌疑。”

王江峰的言论,仅仅是朋友圈私人交友圈子内的言论。王江峰仅仅是一个普通公民。普通公民的私人圈子内的谩骂言论,无论如何都不能达到寻衅滋事罪的“情节恶劣”。

律师同时指出,对侮辱言论的否定性评价,依次有道德批评、民事违法、行政处罚、侮辱罪、寻衅滋事罪。对于公民在朋友圈、在自家客厅辱骂他人的言论,我们相信任何一个有法治观念的人,都不会认为构成最严重的寻衅滋事罪。

律师接着说:“在所有的现代法治国家,当街谩骂国家领导人,举牌谩骂国家领导人,都不构成犯罪,这是常识。作为已经对外开放30多年且誓言要领导经济全球化的中国的法官、检察官、公安干警,特别是那些学习过西方法律思想的政法工作者,我们相信你们肯定也知道这些常识。”

30日的第二次开庭审理,自上午9时开始,中午经短暂休庭后,至下午3时多结束。法庭没有当庭做出宣判,称择日宣判。

早在本次开庭的前一天,警方就在看守所大门周围,为这次庭审特意新安装了四个大号摄像头,在一天的庭审过程中,距离法庭300多米开外的路口一直有十余名公安站成一横排把守。
